For one, a speedy trial is guaranteed by both Federal law (that’s where Smith got the “70 days” idea), and the 6th Amendment.

Or perhaps more favorably, the principle that treason never prospers because, if it does, no one calls it treason (see, e.g., the American Revolution). Eastman’s problem is, he failed. No new regime, no protection from his bad judgment (which might have been “good,” had it prevailed). So, back to FAFO.
